Terms and Conditions of Sale
Kitchen Guys Food Service Equipment (Pty) Ltd, herein referred to as “Kitchen Guys”
- Goods supplied remain the property of Kitchen Guys until paid for in full.
- Goods will only be released once paid in full.
- Payment Terms: 50% deposit on date of order. Balance due before delivery.
- Kitchen Guys will not be responsible for any losses incurred by 3rd parties i.e. contractors and
transport companies.
Kitchen Guys Food Service Equipment (Pty) Ltd will, at its sole discretion, provide the following
remedies to whatever extent it shall deem necessary to satisfy a proper claim under this limited
warranty.
Kitchen Guys warranty is based on the following conditions:
- All the equipment must be maintained by Kitchen Guys Food Service Equipment (Pty) Ltd for duration of the warranty.
- The Kitchen Guys warranty is only valid for equipment which has been paid in full.
- The conditional warranty is only valid for new equipment.
- Any defective workmanship and/or materials used for approved warrantee repairs are covered by the conditional warranty.
- We offer a Six-month electrical warranty from date of completed commissioning.
- A twelve- month mechanical defect warranty from date of completed commissioning.
- A twelve- month warranty on poor workmanship from date of completed commissioning.
- Replacement of components due to a component defect covered by the conditional warranty.
- The balance of the warranty will be calculated from date of commissioning where the ownership of the store is not the original purchaser.
Subject to the following:
- All equipment commissioning must be completed by the appointed Kitchen Guys technician.
- All defective parts must be released and returned to Kitchen Guys offices for review and analysis.
- No modifications or alterations must be done on Kitchen Guys equipment whatsoever.
- Regular services at defined intervals must be maintained as suggested by Kitchen Guys and all services must be completed by an appointed Kitchen Guys technician within the warranty period.
- All equipment should be operated as defined in the Kitchen Guys equipment/training manual and equipment users must not exceed the defined tolerances of the equipment.
Kitchen Guys warranty exclusions:
- Kitchen Guys will not be responsible for consequential loss or injury of any kind.
- Water, drainage and electrical point installation.
- All glass, light bulbs and grease are not covered in the warranty.
- Kitchen Guys will not cover minor adjustments on equipment this includes but is not limited to vent settings, chain re-tensioning, overload settings, tightening of fasteners and connections, replacement of door seals, normal wear and tear due to defined operations.
- Heat exchanger failure due to incorrect flue or burner installation setting, maintenance or the use of inferior fuels is not covered by the warranty. Damage as a result of any surge or fluctuations in the supply of air, water, voltage, current or frequency.
- Damage due to liquids entering electrical components as a result of the equipment being exposed to liquids either through the cleaning process or any other means i.e. rain or burst pipes.
- As a result of incorrect, interrupted (load shedding) or damaged connections on the power supply line or incoming power supply.
- Damages or blockages to filters, nozzles and valves as a result of water and fuel contamination.
- Damage or component failure as a result of operator abuse, neglect or lack of training.
- Damage due to overloading of equipment beyond its recommended capacity or normal operating procedures.
- Damage due to changes on factory setting on safety components.
- Damage or injury due to removing any of the equipment’s standard safety devices.
- Damage or injury as a result of incorrectly curing pans or incorrect standard operating procedures.
- Transport damages when equipment has not been collected or delivered by Tombake.
- Premature failure of drive train components due to lack of maintaining lubricants and tensioning on drive wheels, chains and sprockets, V belts and pulleys, bushes and bearing, belts and connectors, castors, clutch plates.
- Damage to any refrigeration components due to dirty condensing units or operator neglect.
Changes to Terms and Conditions
The Company reserves the right to update and/or amend the Terms and Conditions from time to time and without any notice, and you are accordingly encouraged to check the Website regularly. Any such change will only apply to your use of this Website after the change is displayed on this Website. If you use this Website after such updated or amended Terms and Conditions have been displayed on this Website, you will be deemed to have accepted such updates or amendments.
